INTRODUCTION
Within the scope of its activity, METACLINIC, brand METABOLIC EDGE LDA, with head office at Av. Duque d'Ávila 64 3A, Lisbon, legal person no.º 513089470, (hereinafter "METABOLIC EDGE"), collects personal data related to its Customers, electronically and in person, ensuring that it is processed in accordance with the privacy protection rules emerging from Regulation (EU) 2016/679 (GDPR) and other applicable national legislation, as well as in accordance with the confidentiality duties to which METABOLIC EDGE is subject.
The data collected corresponds to data provided by the clients themselves, or potential clients, by filling in forms.
CONTROLLER
The entity responsible for processing is METABOLIC EDGE insofar as it is responsible for determining the purposes and means of processing its clients' personal data.
TYPE OF DATA PROCESSED BY EMSAUDE
Information about your health; including: reason for consultation/act, personal history (childhood illnesses, immunizations, habits, gynaecological history, allergies, medication, active illnesses, inactive illnesses, eating habits and exercise routines), family history (most common conditions - diabetes, hypertension, PT, cancer, living/deceased, cause of death), clinical examination, diagnoses, complementary exams, referral, alerts (diabetes, hypertension, etc.); prescribed medication.
In order to provide its services, METABOLIC EDGE will necessarily have to collect data relating to your health and, in certain cases, genetic data. As this is a "special category of data", EMSAUDE will observe the most stringent protection requirements laid down in the GDPR with regard to the processing of this data, both with regard to the lawfulness of its processing and the implementation of appropriate technical and organizational measures to minimize its processing, restrict access to this data and guarantee its security.
PURPOSES OF PROCESSING
METABOLIC EDGE uses your data above to make appointments, medical diagnosis, to provide health care and consultancy. The data collected will be based on the need for treatment for the purposes of nutrition and health treatments.
Data relating to your health will only be processed by or under the responsibility of professionals bound by confidentiality, to the strict extent necessary for the provision of health care, and may only be communicated to your family members in the circumstances expressly provided for in the law in force.
RIGHTS OF PERSONAL DATA SUBJECTS
Under the terms of the applicable law, Customers who hold personal data have the following rights:
(a) Right to InformationThis consists of the right of clients to be informed by METABOLIC EDGE, among other things, about the purpose for which their data is being processed, to whom it can be communicated, what rights they have and under what conditions they can exercise them, as well as what data they are obliged to provide;
(b) Right of AccessThis consists of the right of Clients to access their personal data that they have provided, without restrictions, delays or excessive costs, and to know any information available about the origin of that data;
(c) Right of rectificationMETABOLIC EDGE's right to rectify data is the right of customers to demand that their data be accurate and up-to-date;
(d) Right to Delete (or "forgetfulness"), which consists of the right of Clients to demand the deletion of their personal data from METABOLIC EDGE's records when they are no longer used for the purposes for which they were collected, without prejudice, however, to the retention periods imposed by law;
(e) Right of OppositionThis consists of the right of customers to object, at their request and free of charge, to the processing of their personal data;
(f) Right to PortabilityThis is the right of Clients to receive the personal data they have provided to METABOLIC EDGE, in a structured, commonly used and machine-readable format, and to transmit this data to another data controller.
(g) Right to Restriction of ProcessingThis right consists of the right of Clients to request METABOLIC EDGE to limit the processing of their data in certain circumstances, namely (i) when they dispute the accuracy of their personal data, for a period that allows METABOLIC EDGE to verify its accuracy; (ii) if the processing is unlawful and the Client opposes the erasure of the data, requesting instead the limitation of its use; or (iii) when METABOLIC EDGE no longer needs the Client's personal data for processing purposes, but such data is required by the Client for the purposes of declaring, exercising or defending a right in legal proceedings;
(h) Right to complain to the CNPD, which consists of the right to lodge, without prejudice to any other administrative or judicial remedy, a complaint with a supervisory authority, in particular in the Member State of the data subject's habitual residence, place of work or place of the alleged infringement, if the data subject considers that the processing of personal data concerning him or her infringes the GDPR and other applicable national legislation. In Portugal, the supervisory authority is the National Data Protection Commission.
In order to exercise any of their rights, including accessing their data or requesting its rectification, deletion or objection to its processing under the terms of the law, Clients should contact METABOLIC EDGE by letter: geral@metabolicedge.pt.
DATA RETENTION PERIOD
Your data will be kept by METABOLIC EDGE in strict compliance with the applicable legislation and will be stored in a specific database created for this purpose. This data is kept in a format that allows the identification of data subjects for no longer than is necessary for the purposes for which it is processed. The length of time for which data is stored and retained varies according to the purpose for which the information is used. There are, however, legal requirements that oblige data to be kept for a certain period of time. To this extent, data relating to your health is stored in accordance with the legislation applicable to the archiving of hospital documentation.

METABOLIC EDGE undertakes to adopt appropriate technical and organizational measures to protect the data over which it is responsible for processing against accidental or unlawful interference leading to unauthorized destruction, alteration, disclosure or access, as well as any other form of unlawful processing.
To this end, METABOLIC EDGE has a set of security technologies and procedures to protect users' personal data from unauthorized access, use or disclosure, such as storing the personal data collected in computer systems with limited access and located in controlled facilities.
CHANGES TO THE PRIVACY POLICY
